LEAPTYME TERMS OF USE

1. Introduction

These Terms of Use (“Terms”) govern your access to and use of Leaptyme, a private communication and transparency platform provided by Abrasax.Technology, operated by Jose Padilla (“Leaptyme,” “we,” “our,” or “us”).

By accessing or using Leaptyme, you agree to these Terms. If you do not agree, you should not use the platform.

2. What Leaptyme Is

Leaptyme is a private communication platform designed for programs, staff, participants, families, and authorized representatives.

Leaptyme may be used for private messages, announcements, posts and updates, photos and videos, forms and signatures, program communication, family visibility and transparency, and internal community engagement.

Leaptyme is not a medical records system, healthcare platform, therapy platform, treatment platform, emergency service, or legal recordkeeping system.

3. Program-Operated Instances

Each program using Leaptyme operates its own private instance of the platform.

Programs are responsible for inviting users, managing access, setting roles and permissions, configuring visibility settings, obtaining required consents, reviewing posted content, and ensuring lawful and appropriate use of the platform.

Leaptyme provides the technology platform but does not control the day-to-day decisions, communications, or content posted by each program.

4. Eligibility

You may use Leaptyme only if you are authorized by a participating program or by Leaptyme.

By using the platform, you represent that you are at least 18 years old, or using the platform under the supervision and consent of a parent, guardian, or authorized representative; that you have permission to access the program instance you are using; that the information you provide is accurate and current; and that you will use the platform only for lawful and appropriate purposes.

5. Accounts and Login Credentials

Users may be required to create an account to access Leaptyme.

You are responsible for keeping your login credentials confidential, using a secure password, not sharing your account with others, and promptly notifying the program administrator or Leaptyme if you believe your account has been compromised.

You are responsible for activity that occurs under your account.

Leaptyme may suspend or disable accounts if we believe they are being misused, compromised, or used in violation of these Terms.

6. Acceptable Use

You agree to use Leaptyme respectfully, lawfully, and only for its intended purpose.

You may not use Leaptyme to harass, threaten, abuse, exploit, or harm others; post false, misleading, defamatory, or harmful content; share obscene, violent, hateful, discriminatory, or abusive material; upload malware, viruses, harmful code, or unauthorized scripts; attempt to bypass access controls or security systems; access information you are not authorized to view; impersonate another person; interfere with platform operation; use the platform for spam, scams, fraud, or unauthorized advertising; scrape, copy, harvest, or misuse user data; or violate any applicable law, regulation, or program policy.

7. User Content

Users and programs may upload, post, send, or submit content through Leaptyme, including messages, posts, comments, media, files, forms, and signatures (“User Content”).

You retain ownership of content you submit, but you grant Leaptyme a limited license to store, display, transmit, process, and make that content available as needed to operate the platform.

This license is limited to providing and supporting Leaptyme. We do not sell your content or use it for third-party advertising.

You are responsible for ensuring that content you upload or share is accurate to the best of your knowledge, does not violate another person’s rights, does not include prohibited or unlawful material, is appropriate for the program community, and complies with these Terms and the program’s own policies.

8. No Medical Records or Protected Health Information

Leaptyme is not intended to store, transmit, process, or manage medical records, treatment records, diagnostic information, therapy notes, medication information, healthcare billing information, or Protected Health Information (“PHI”) under HIPAA.

Users and programs agree not to upload, post, send, store, or transmit PHI or regulated healthcare data through Leaptyme.

Leaptyme does not provide healthcare services and does not act as a HIPAA covered entity or business associate unless a separate written agreement expressly states otherwise.

General updates, family communication, community posts, photos, announcements, and program visibility features are permitted, but users and programs must avoid including regulated medical or treatment information.

9. Consent for Photos, Videos, and Likeness

Programs are responsible for obtaining appropriate consent before uploading, posting, or sharing photos, videos, names, likenesses, or identifying information about participants, minors, families, staff, or other individuals.

Leaptyme may provide visibility and consent tools, but the program is responsible for using them correctly.

Users may not upload or share images, videos, or identifying information about another person unless they have the right or permission to do so.

10. Moderation and Monitoring

Program administrators and authorized staff may review, moderate, remove, restrict, or archive content within their Leaptyme instance.

Leaptyme may also review content or account activity when necessary to provide support, investigate misuse, maintain security, enforce these Terms, comply with legal obligations, and protect users, programs, or the platform.

Users should not expect content posted on Leaptyme to be private from authorized program administrators.

11. Program Policies

Each program may have its own policies, consent forms, privacy notices, communication rules, conduct standards, or participation agreements.

You agree to follow both these Leaptyme Terms of Use and any applicable program rules or policies.

If there is a conflict between program rules and these Terms, these Terms control your use of the Leaptyme platform, but the program may separately enforce its own rules.

12. Communications and Notifications

By using Leaptyme, you agree that the platform may send you communications related to your account or program participation, including account notices, security alerts, messages, announcements, form requests, signature requests, program updates, support communications, and administrative notices.

These communications may be sent through the platform, by email, by SMS, or through other available notification methods depending on the program’s configuration.

13. SMS and Mobile Messaging

If SMS or mobile messaging features are enabled, you may receive text messages related to Leaptyme activity or program communication.

Message frequency may vary. Message and data rates may apply.

Where supported, you may opt out of SMS messages by following the instructions in the message or by contacting your program administrator.

Leaptyme does not sell or share mobile phone numbers for third-party advertising or marketing.

14. Fees and Program Subscriptions

Programs may pay fees for use of Leaptyme. Individual users may not be charged directly unless expressly stated.

Program subscription terms, pricing, billing, cancellation, refunds, and service levels may be governed by a separate agreement between Leaptyme and the program.

Leaptyme may suspend or terminate a program’s access for nonpayment, misuse, violation of these Terms, or other lawful reasons.

15. Availability and Platform Changes

We aim to keep Leaptyme reliable and available, but we do not guarantee uninterrupted access.

Leaptyme may be unavailable due to maintenance, updates, security work, hosting issues, third-party service interruptions, internet outages, or unexpected technical problems.

We may modify, improve, limit, suspend, or discontinue features at any time.

16. Security

We use reasonable safeguards to protect the platform, but no system is perfectly secure.

You agree not to attempt to gain unauthorized access, test or attack the platform without permission, circumvent security controls, share credentials, upload malicious files or code, or interfere with platform operation.

If you discover a security issue, you must report it responsibly to Leaptyme and not exploit or disclose it publicly before we have had a reasonable opportunity to address it.

17. Third-Party Services

Leaptyme may rely on third-party services for hosting, storage, notifications, email delivery, SMS delivery, analytics, payment processing, support, or security.

We are not responsible for third-party services outside our control. Your use of third-party links, integrations, or services may be subject to their own terms and policies.

18. Intellectual Property

Leaptyme, including its software, design, branding, logo, interface, features, documentation, and related materials, is owned by Abrasax.Technology or its licensors.

You may not copy, reproduce, modify, distribute, reverse engineer, sell, lease, or create derivative works from Leaptyme except as expressly authorized in writing.

These Terms do not transfer ownership of Leaptyme or any related intellectual property to you or to any program.

19. Feedback

If you provide feedback, ideas, suggestions, bug reports, feature requests, or recommendations, you allow us to use them without restriction or compensation.

We may use feedback to improve Leaptyme, create new features, modify existing features, or develop related products and services.

20. Account Suspension or Termination

Leaptyme or the program may suspend, restrict, or terminate user access if you violate these Terms, violate program policies, your account is compromised, your access is no longer authorized by the program, your use creates legal, security, safety, or operational risk, or the program ends its use of Leaptyme.

Upon termination, your access to the platform may end immediately. Certain content may remain stored, archived, exported, or retained according to the program’s instructions, legal obligations, or our Privacy Policy.

21. Disclaimers

Leaptyme is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, and error-free operation.

Leaptyme does not guarantee that the platform will meet every program’s requirements or that all communications will be delivered without delay, interruption, or error.

22. Not Emergency, Medical, Legal, or Professional Advice

Leaptyme is not an emergency communication system. Do not use Leaptyme to report emergencies, urgent safety issues, medical emergencies, abuse, neglect, or time-sensitive events requiring immediate response.

In an emergency, contact emergency services, law enforcement, medical professionals, or the appropriate authority directly.

Leaptyme does not provide medical, legal, financial, therapeutic, or professional advice.

23. Limitation of Liability

To the fullest extent permitted by law, Leaptyme, Abrasax.Technology, Jose Padilla, and related service providers will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including damages for lost profits, lost data, service interruption, unauthorized access, user conduct, program conduct, content posted by users or programs, or third-party service failures.

To the fullest extent permitted by law, our total liability for any claim related to Leaptyme will not exceed the amount paid to Leaptyme for the service giving rise to the claim during the three months before the claim arose, or $100 if no amount was paid.

24. Indemnification

You agree to defend, indemnify, and hold harmless Leaptyme, Abrasax.Technology, Jose Padilla, and related service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of Leaptyme, your violation of these Terms, your User Content, your violation of another person’s rights, your violation of law, or your misuse of the platform.

Programs agree to indemnify Leaptyme for claims arising from their users, content, consents, privacy practices, program policies, or misuse of the platform.

25. Privacy

Your use of Leaptyme is also governed by the Leaptyme Privacy Policy, which explains how information is collected, used, stored, and protected.

By using Leaptyme, you also agree to the Privacy Policy.

26. Changes to These Terms

We may update these Terms from time to time.

When we update them, we will revise the “Last updated” date. If changes are significant, we may notify users through the platform, by email, or by another appropriate method.

Continued use of Leaptyme after updated Terms become effective means you accept the updated Terms.

27. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes arising from or related to these Terms or Leaptyme will be handled in the courts located in California, unless applicable law requires otherwise.
